Employment based Immigration

Employment-based immigration allows individuals to immigrate to the United States based on their job skills, qualifications, and employment opportunities. Each year, approximately 140,000 employment-based immigrant visas are available, divided into five preference categories.

Employment based immigration categories

EB-1: Priority Workers

  • Individuals with extraordinary abilities in sciences, arts, education, business, or athletics.

  • Outstanding professors and researchers with international recognition.

  • Multinational executives and managers who have worked for at least one year in the past three years for the same employer abroad.

EB-2: Professionals with Advanced Degrees or Exceptional Ability

  • Advanced degree professionals holding a degree beyond a bachelor's or a bachelor's degree with at least five years of progressive experience.

  • Individuals with exceptional ability in the sciences, arts, or business, demonstrating a level of expertise significantly above the ordinary.

EB-3: Skilled Workers, Professionals, and Other Workers

  • Skilled workers with at least two years of job experience or training.

  • Professionals holding at least a U.S. bachelor's degree or its foreign equivalent.

  • Other workers performing unskilled labor requiring less than two years of training or experience.

EB-4: Certain Special Immigrants

  • Religious workers.

  • U.S. government employees abroad.

  • Other special categories including certain broadcasters, translators, and international organization employees.

EB-5: Immigrant Investors

  • Investors who invest a minimum of $1 million (or $500,000 in a targeted employment area) in a new commercial enterprise that creates at least 10 full-time jobs for U.S. workers.

The process generally involves obtaining a labor certification from the U.S. Department of Labor, having an employment-based immigrant petition approved by U.S. Citizenship and Immigration Services (USCIS), and completing consular processing or adjustment of status to become a lawful permanent resident. Immediate family members (spouses and children) can also obtain visas to accompany the principal applicant.
