Political Asylum

Political asylum law in the United States provides protection to individuals who have fled their home countries due to a well-founded fear of persecution. This persecution must be based on one of the following grounds: race, religion, nationality, membership in a particular social group, or political opinion. Asylum seekers may apply for protection either upon arrival in the U.S. or within one year of entering the country.

Eligibility

The applicant must demonstrate that they have suffered persecution in the past or have a credible fear of future persecution in their home country due to one of the five protected grounds.

They must also show that the government in their home country is either responsible for the persecution or unable/unwilling to provide protection.

Application Process

Affirmative Asylum: Applied for voluntarily by individuals who are not in removal proceedings. The applicant files Form I-589, Application for Asylum and for Withholding of Removal, with U.S. Citizenship and Immigration Services (USCIS).

Defensive Asylum: Applied for as a defense against removal from the U.S. during immigration court proceedings.

Benefits of Asylum

Asylum grants the right to live and work in the United States.

After one year of being granted asylum, the asylee can apply for lawful permanent residency (a green card).

Asylees can also petition to bring their spouse and unmarried children under 21 to the U.S. through a process called "derivative asylum."

Path to Citizenship
